The information reported by www.TrackAndScreen.com hereby known as (TAS) and its databases, including all criminal records, criminal background checks, tenant screening background checks and credit report verifications constitute personal information that is regulated by the Fair Credit Reporting Act (FCRA). The provisions of the FCRA can be found at http://www.ftc.gov/os/statutes/031224fcra.pdf . The Site is required to comply with certain provisions of the FCRA, including:

§604. Permissible purposes of consumer reports [15 U.S.C. § 1681b]
Section 604, limits the purposes for which information may be provided. The Customer (Account holder\Landlord) must certify that the information is sought to be used for (or provided for) tenant screening purposes,  purposes related to a business transaction initiated by the Customer\Landlord (Account holder), employment; other purposes as defined by the FCRA of Section 604 as outlined in the permissible purposes detail.

1. The applicant authorized the background report(s) to be generated.
2. The applicant has received a disclosure in writing before the report is ordered.
3. The account holder will not use any Information from the background report(s) in violation of any Federal\State or EEOC, Fact Act law or rule.
4. The account holder certifies that before taking adverse action in whole or in part based on a background report for Tenant Screening or Employment purposes it will provide the consumer the following:

• A copy of the Consumer Report
• A copy of the consumer rights approved by the FTC (Fair Trade Commission)

AGREEMENT: I agree to hold all Background information as confidential and not to disclose any of it, in whole or in part, to any third party not involved in the related, specific transaction. I agree not to alter the content, sell or give away information obtained from www.TrackAndScreen.com and comply with Public Law 91-508, The Fair Credit Reporting Act. I also agree to use the information obtained from www.TrackAndScreen.com only for the purpose (s) stated on this agreement. Upon signing this agreement, I acknowledge that all statements and information are true and correct. This Agreement shall not be binding until accepted by CYS. A copy of facsimile of this agreement shall be as valid as the original.

CRIMINAL RECORDS: I understand that the purpose for a Criminal search must meet the following requirements: Freedom of Information Act 5USC552; Crime Control Act, Privacy Act- Public Law 93-579 5USC22(a), The Fair Credit Reporting Act - Public Law 91-508; and all other state or federal laws.

FEES: I understand that the charges will be applicable whether or not records are found. TAS reserves the right the change its fees and prices at any time.

INDEMNIFICATION: I shall indemnify and hold TAS harmless of any claims made based on information received from TAS. I understand that TAS will make every effort to gather information from reliable sources but does not guarantee the accuracy, completeness of information or results. I agree that the information provided will be used for the legal purpose authorized. I understand that TAS assumes no liability for any misuse of information either directly or indirectly.  

LIABILITY: I, the Account holder assume all legal liability and agree to indemnify www.TrackAndScreen.com, its parent company, subsidiaries, affiliates, partners, employees etc harmless for errors or omissions or for any consequential damages however arising, including damages arising from the use or misuse of the information provided. This includes any claim(s) that may result based on any information received or not received from TAS.

MEMBERSHIP:  I understand that TAS will furnish me The Account holder, background information for a one-time use only. I agree to provide TAS with ID and any other personal or business identifiable information as verification when requested.

PERMISSION:  I certify that a signed authorization has been received from the applicant and I will retain the authorization on record for a period of not less than two (2) years. I also agree to send this signed authorization to www.TrackAndScreen.com via fax to TAS.

RESTRICTIONS: I certify and agree that I will request and use criminal conviction history information, tenant screening, or records of any other kind received from TAS only in connection with transactions involving the applicant. I agree to use and maintain all information provided by TAS as required by law and disclosed only to business partners whose responsibilities relate to the legitimate business purpose for which the information is requested. I agree not to sell or otherwise distribute to any third parties any information received hereunder, except as otherwise required by law.

TERMS: I understand that this Agreement shall continue in force without any fixed date of termination. I understand that this Agreement shall not be altered, varied, enlarged upon by any verbal promises, statements or representations not expressed herein. I also understand that this agreement shall be interpreted in accordance with the laws of the State of New York. TAS may terminate the Agreement at any time based on failure to adhere to the terms and conditions of this Agreement.

I understand that any searches that I have purchased are non-transferable to another person. I also understand that following 1 year of inactivity, my account will be considered abandoned.

I have read, understand and agree to all the terms as listed above.
